Sitzer | Burnett commission lawsuit

The National Association of Realtors entered into a settlement agreement that would end litigation of claims brought on behalf of home sellers related to broker commissions. This settlement is still subject to court approval.

If you follow the story in the news media you’ll find misconceptions about the impact this settlement will have. The most important misconeption is about commissions. Commissions to a brokerage are and always have been negotiable.

Disclosure of the commission on MLS will no longer be permitted effective some time in July 2024. There is no prohibition for seller to continue to offer a Buyer's brokerage commission.

Another highlight of the settlement is the provision that will require buyers to enter into buyer representation agreements with their buyer brokerage. This is currently required in 14 states. In my opinion this is good practice for all involved.
